User Agreement
Netlink IP Communications agrees to provide its users with authenticated local access "always available" to
the Internet via dial-up or dedicated connections. User agrees to pay for this service through a Monthly,
Quarterly, Semi-Annually or Annual fee in advance. (See Services)
The User shall abide by the general "acceptable use" policies of the Internet, which, among other things,
prohibit unauthorized advertising or use for any unlawful purposes. Users' behavior on Internet protocols such
as IRC can cause our entire service to be prohibited from connecting to that protocol. Netlink IP Communications
reserves the right at its' sole discretion to determine when User has violated such polices, and should Users'
behavior become unacceptable, Netlink IP Communications reserves the right to terminate their agreement.
The User's account with Netlink IP Communications will not be transferred or used by anyone other than User,
except for User's immediate family in the same household. User will not intentionally make multiple connections
to Netlink IP Communications with the same account by logging in simultaneously on two or more different computers.
Payment options are available to bill multiple usernames to the same account. Accounts transferred to other parties
or show other activity in violation of this agreement are subject to immediate supervision or cancellation at Netlink
IP Communications' discretion. Cancellation may be rescinded at Netlink IP Communications' sole discretion following
the payment of a $10.00 reconnection fee. User agrees to indemnify and hold harmless Netlink IP Communications from
any claims resulting from User's use or inability to use the service. Unauthorized reselling of Netlink IP Communications
services or the unauthorized connection of bulletin board services, computer networks, or on-line services to the Internet
via Netlink IP Communications is prohibited. Monthly and annual fees for services are subject to change at our sole
discretion, except those accounts with annual billing will remain at the previous rate until their next anniversary in
the event of a price increase.
All Past Due accounts are Subject to a $10.00 administrative billing fee. If account is past due and must be invoiced,
User agrees to pay 1.75% Interest per month after Due Date, per applicable Georgia statutes on invoiced accounts.
User also agrees to pay all balances due for Internet Access and Related Internet Services including but not limited
to Domain Registration, Web Site Development, etc. prior to account cancellation or transferal. Credit Cards declined
due to User's "reaching their limit," or because of an expired expiration date will be charged a $7.50 merchant transaction
reprocessing fee per decline, per month. It is the sole responsibility of the user, to inform Netlink IP Communications of
changes in credit card numbers and/or expiration dates. If card expiration date is extended it is the cardholder's
responsibility to inform Netlink IP Communications of the same. If cardholder reverses charge or refuses payment for 3 month
minimum, the undersigned agrees to be liable for a $20.00 charge back fee to cover credit card processing fees. The charge
back fee is payable in cash, check, or money order.
Dial-up Accounts are subject to timeout restrictions. Should a dial-up connection remain inactive for a period of thirty
(30) minutes, the port will be reset. Upon a timeout, dial-up users may simply reconnect at their discretion. Dial-up accounts
are also subject to maximum session limits. A dial-up connection may remain active for a specified period of time (currently
twenty hours) before disconnect is requested. This limit may be enforced and changed at any time. Please note that this
does not restrict dial-up accounts from reconnecting and is intended only for the benefit of all users.
Home Pages on Personal Accounts are intended for personal use only. Those Users whose web pages exceed 300 Mb of transfer
per month will, upon request by Netlink IP Communications, either remove their pages or transfer their account to a Commercial
Account. Commercial Accounts are limited to 1 Gigabyte of transfer per month. Additional transfer will be billed monthly at
$0.04 per Mb with a minimum charge of $10.00 per month.
Netlink IP Communications exercises no control whatsoever over the content of information on the Internet nor will we monitor
or screen "offensive" materials. Netlink IP Communications makes no warranties of any kind, whether expressed or implied,
for the service it is providing. Netlink IP Communications also disclaims any warranty of merchantability or fitness for a
particular purpose. Netlink IP Communications will not be responsible for damages suffered by User, including, but not
limited to, the loss of data for any reason caused by its own negligence, User's errors, or due to the fault of third parties.
Neither Netlink IP Communications nor Owner are responsible for problems related to your hardware, telephone, or Internet
network, delays, omissions, or actions related to Internet access.
Netlink IP Communications reserves the right to cancel service for any reason without prior notice. Should a User wish to
terminate their agreement, there will be no refund of unused monthly fees, as these are paid in advance for the entire month.
Quarterly, Semi-Annual, and Annual subscribers will be refunded any full remaining months at the monthly rate for that type
of account less a $65.85 / 3 Month Minimum. Termination of services by Netlink IP Communications does not constitute relief of
User from unpaid debts incurred before termination of this agreement. Termination of services will be accepted in person,
or by postal mail to Netlink IP Communications, 9 St. Andrews Courtyard Suite 103, Brunswick, GA 31520, or by fax (912)
267-6676. In the event Netlink IP Communications retains an attorney to collect any such unpaid debts, User shall be
responsible for the payment of all Netlink IP Communications attorney's fees and costs in pursuing the collection of unpaid
debts. Venue for any litigation concerning this agreement shall be in Glynn County, Georgia.
Installing Netlink IP Communications Software and/or Negotiating Compatible Network Protocols constituting a recorded Log-in
constitutes Full Agreement. (If you do not agree to the terms as stated above, do not perform Log-In.)
